In the Town of Ingalls, the Board of Zoning Appeals (BZA) hears and decides upon appeals of decisions made by the Planning Director and staff regarding the interpretation or application of the Unified Development Ordinance (UDO). The BZA is responsible for making decisions on requests for special exceptions, variances, and other zoning-related issues. The BZA operates independently from other governmental agencies and is intended to provide a fair and impartial forum for the resolution of zoning disputes. Members of the BZA are appointed according to Indiana Code and serve a set term of three years. The BZA meets, as-needed, on the third Monday of the month to consider pending appeals and make decisions based on the evidence presented by interested parties.

  • Who Completes Certified Mailers & Notices?

    The applicant is responsible for sending the Notice of Public Hearing to the publisher (typically the Herald Bulletin) as well as mailing the Notice to Interested Parties via certified mail to all property owners within 300 feet. The publication must be posted and all mailers must be sent at least 10 days prior to the public hearing. A list of interested parties may be obtained by reaching out to Town Hall. 


    Please note that the publication day is typically three business days after you submit your notice to the Herald Bulletin. 

  • When does the BZA meet?

    The BZA meets as needed. However, the third Monday of every month (excluding holidays) has been set aside for BZA hearings. 

  • When do I need to turn in my application?

    A complete application and all supporting materials must be submitted at least 30 days prior to your scheduled public hearing date. You will also need to publish a Notice of Public Hearing and send out certified mailers to all Interested Parties at least 10 days prior to your scheduled public hearing date. Proof of notices must be submitted prior to the public hearing. 

  • What is a proof of notice?

    For the publication of your Notice, a scanned copy of your "Proof of Publication" will work. 


    For certified mailers, scanned copies of the green cards or copies of your receipt will work. You may also bring in the physical green cards prior to your public hearing. 

  • What if I miss one of the required deadlines?

    Unfortunately, if a deadline is missed (for example, not getting a notice published at least 10 days prior to a meeting) we will need to reschedule your public hearing date to the following month and you will need to send out all notifications again. Public notice requirements are set by Indiana Code and cannot be altered by the Town. 

  • Can I get a refund if the BZA denies my request?

    Unfortunately, the cost of your application is set by the Fee Schedule and is based on the time and resources needed to review your application and hold the public hearing. Regardless of the outcome, refunds will not be issued. 

  • Can I reapply if the BZA denies my request?

    If an applicant's request is denied by the BZA, they must wait for a minimum of one year before submitting another application for the same request. 

  • What if I disagree with the BZA?

    If your request is denied by the BZA, you can either wait for a year to reapply or take your case to a trial court.
